Nebraska Activity #78667, 5.25 hours of CLE/.5 hours of Professional Responsibility/CLE
The first part of this program will focus on assisting juvenile defense counsel understand the ethical obligation in representing the juvenile’s expressed interests and ensure that their rights are sufficiently protected and advanced throughout the entirety of their case. Objectives will include a discussion on how the role of a juvenile defender is similar yet different from that of an adult defender and understanding the need to maintain loyalty to their client and his/her stated interests.
In the second part of this program, the juvenile defender will understand the law and strategy of challenging the admissibility of a client’s statement. Objectives will include the impact of adolescent development on the voluntariness of the statement and the capacity of the youth to knowingly, intelligently and voluntarily waive Miranda, understanding principles of law associated with interrogation in schools and discussing the research on false confessions along with the strategies for challenging their admission pre-trial and/or their evidentiary value during trial.
